1. Introduction

These Terms of Service (“Terms”) govern your use of MisuJob (the “Service”), operated by Fodoj GmbH (“we”, “us”, “our”).

By creating an account or using our Service, you agree to be bound by these Terms.

2. Service Description

MisuJob is an AI-powered job search platform that:

Matches your profile with relevant job opportunities using AI algorithms
Automatically applies to jobs on your behalf (with your explicit permission)
Analyses your CV using artificial intelligence to extract skills and experience
Tracks your job applications
Provides career insights and analytics

2.1 AI Processing

Our Service uses artificial intelligence (AI) to process your career data. Specifically:

CV Parsing: Your CV is analysed by AI to extract skills, work experience, and education. Personal identifiers (name, email, phone) are automatically redacted before AI processing.
Job Matching: AI compares your profile with job requirements to generate match scores (0-100%) with an 8-factor explanation.
Cover Letters: AI can generate personalised cover letters based on your profile and job requirements.
Auto-Apply: With your permission, AI selects matching jobs and applies on your behalf.

You can review match explanations for every recommendation and request human review of any automated decision.

3. Account Registration

3.1 Eligibility

You must be at least 16 years old and legally capable of entering into contracts to use our Service.

3.2 Account Security

You are responsible for:

Providing accurate information
Maintaining the confidentiality of your password
All activities under your account

3.3 One Account Per Person

Each user may only maintain one account.

4. Subscription Plans

4.1 Free Plan

All users start with a free plan that includes:

Top 20 match scores visible
10 detailed match reports per month
Basic career situation overview
No auto-apply or connected sites

New users receive a 7-day trial with full Pro features upon registration.

4.2 Paid Plans

The following paid plans are available:

Pro (€19.99/month)

Everything in Plus

4.3 Billing

Subscriptions are billed monthly or annually depending on the plan
Payments are processed through Stripe
You can cancel anytime; access continues until the end of the billing period
No automatic charges occur; users must actively choose and subscribe to a paid plan

5. User Obligations

5.1 Accurate Information

You must provide accurate information in your profile and CV. Misrepresentation may result in account termination.

5.2 Job Site Credentials

When connecting job site accounts (e.g., freelance.de, freelancermap):

You confirm you have the right to access these accounts
You authorise MisuJob to act as your authorised representative (Bevollmächtigter) to search for and apply to jobs on your behalf
You understand that we store encrypted credentials (AES-256-GCM)
You can disconnect your accounts and revoke authorisation at any time

5.3 Prohibited Uses

You may not:

Use the Service for any illegal purpose
Create fake profiles or applications
Attempt to circumvent security measures
Resell or redistribute our Service
Use automated tools to access our Service (beyond our intended features)
Spam employers or abuse the application system

6. Data Portability and Export

You can export all your personal data at any time in a machine-readable JSON format (GDPR Art. 20). Use the data export feature in your account settings or call GET /api/user/export with your authentication token.

You can delete your account and all associated data at any time from your profile settings (GDPR Art. 17).

7. Intellectual Property

7.1 Our Content

MisuJob, including its design, features, and content, is protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

7.2 Your Content

You retain ownership of your CV and profile information. By using our Service, you grant us a license to use this content to provide our services, including AI-powered matching and analysis.

8. Limitation of Liability

8.1 Service Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for temporary unavailability.

8.2 Job Applications

While we make reasonable efforts to submit applications correctly:

We cannot guarantee that all applications will be successful
We are not responsible for employer responses or hiring decisions
Job listings are sourced from third-party platforms; we do not verify their accuracy
AI match scores are indicative, not guaranteed

8.3 AI Processing

AI-generated content (cover letters, match explanations, summaries) is provided as assistance and may contain errors. You are responsible for reviewing and approving any content before it is submitted to employers.

8.4 Maximum Liability

To the maximum extent permitted by law, our liability is limited to the amount you have paid us in the 12 months preceding any claim.

9. Indemnification

You agree to indemnify and hold us harmless from any claims arising from:

Your violation of these Terms
Your use of the Service
Content you submit to the Service

10. Termination

10.1 By You

You may terminate your account at any time through your account settings or by contacting us.

10.2 By Us

We may terminate or suspend your account if you:

Violate these Terms
Engage in fraudulent activity
Abuse our Service

10.3 Effect of Termination

Upon termination:

Your access to the Service ends
Your data will be deleted according to our Privacy Policy
No refunds for partial billing periods

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of Germany.

12.2 Jurisdiction

Any disputes shall be resolved in the courts of Munich, Germany.

13. Miscellaneous

13.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service.
